Over the last twenty-five years, courts and business have increasingly begun to see the value of mediation. In fact, some courts require almost every case that is filed to go to mediation or some other form of Alternative Dispute Resolution. They recognize that the formal legal process is not always the best method of resolving disputes. Businesses are putting mediation into contracts and adopting the mediation process internally to resolve employee disputes, reducing turnover and exposure to litigation. Experienced attorneys, sometimes refer cases to mediation even when it is not required, recognizing that mediation can often be a better alternative to a civil jury trial, reducing risk and expense.
